The Supreme Court of the US will allow Texas abortion law to have a total ban. But it will now take up the case to the next month with a rare kind of sped-up porches. The law, SBB, gives any person complete right to sue the doctors who are performing an abortion past six weeks. It says that before this time, most of the women know that they are pregnant.
The Supreme Court has said that it will focus on the crafting of the law and whether it can be challenged or not. It is quite extraordinary and rare for the top US court to expedite any car. The Lower courts are yet to issue any kind of final rulings on the Texas heartbeat Act.
The controversial Texas abortion law is making an exception for the documented medical emergency but not for the case of rape or incest. It bans abortion after the starting of the fetal heartbeat.
The American College of Obstetricians and Gynecologists say that at six weeks, a fetus does not develop a heartbeat.
The Texas law gives any individual the right to sue doctors who perform any kind of abortion at this stage. However, it does not allow the women who get the procedure. The Biden administration previously said that it would ask the court to block the law. The US is one of 7 out of 198 countries to allow for abortions after 20 weeks of pregnancy.
Lawyers of Texas have asked the justices on the court to consider the overruling of the landmark Roe decision. Also, there is a separate case that gave affirmation for the constitutional right to an abortion. However, the court did not accept that request.
The Supreme Court Justice Sonia Sotomayor said that the timeframe would offer cold comfort to women in Texas who are now hoping for the treatment of abortion.
She was the only one in the nine judges who have advocated for the blocking of the law in the short term.
“Women seeking abortion care in Texas are entitled to relief from this court now,” she wrote. “Because of the court’s failure to act today, that relief, if it comes, will be too late for many.”
