Operator of construction site sentenced to four years probation over fatal accident.

A recent verdict by the Taichung Taiwan High Court in a workplace safety negligence case has sparked attention. The tragic incident occurred last year at a construction site of a kindergarten in a rural area of Hsinchu County. A male operator of an excavator, surnamed He, was operating the machine during a foundation backfilling and soil excavation process when he accidentally buried the deceased body of Chen, a responsible person from a construction company, under a large amount of soil. Chen died of asphyxiation. The prosecution subsequently brought charges against He for negligence resulting in death, and the case was heard by the Taichung District Court. After considering the circumstances, the judge sentenced He to an eight-month imprisonment, suspending the sentence for four years, allowing for potential appeal.

According to the Taichung District Court's verdict, the incident occurred when the kindergarten construction site was carrying out backfilling and land leveling work. The deceased Chen, a responsible person from a construction company, was lying in a deep pit at the site, while He, the male operator of the excavator, was operating the machine to fill the pit with soil without ensuring the safety of those around him. As He directly operated the machine under limited visibility without checking the situation inside the pit, a large amount of soil and debris poured down, instantly burying Chen. When other workers discovered the situation and rescued him, Chen was already lifeless and unable to be revived. The sudden workplace accident has left a family forever separated.

This case has once again brought to light the issue of safety management in the construction and civil engineering industry. In various types of construction, renovation, and kindergarten expansion projects, heavy machinery such as excavators, cranes, and large trucks are frequently used, often creating blind spots and potential hazards. According to labor standards and occupational safety and health regulations, a controlled area should be set up around heavy machinery during operation, and a dedicated commander or guide should be assigned to monitor the situation. However, in practice, many small-scale projects or construction companies often overlook safety protocols due to staff shortages or cost-cutting measures, which can lead to irreparable tragedies.

In the judicial review process, the judge evaluated He's actions comprehensively. The crime of negligence resulting in death requires that the perpetrator fails to notice a situation that they should have noticed, leading to the death of the victim. He, as the operator of a high-risk heavy machine, had an objective duty to ensure the safety of those around him. His failure to fulfill this responsibility resulted in the death of his colleague, Chen. The judge also took into account various circumstances, including He's good attitude during the investigation, his admission of guilt, and his efforts to make amends with Chen's family by settling a civil compensation agreement of NT$2,470,000, which was a crucial factor in the judge's decision to grant a suspended sentence.

The purpose of the suspended sentence system under the Taiwan Criminal Code is to provide an opportunity for offenders, who are first-time offenders or have a low likelihood of reoffending, to reform and avoid the negative stigma associated with imprisonment. In this case, He was guilty of causing the death of a colleague due to negligence, and he must bear the consequences. However, the court took into account his efforts to make amends with Chen's family and fulfilled his civil compensation obligations, and thus, suspended his sentence for four years, with certain conditions to ensure the effectiveness of the suspended sentence. This verdict marks the end of the judicial process for this case and serves as a reminder to all workers and industry practitioners involved in construction and civil engineering that safety must always be the top priority in fast-paced construction sites, where even the smallest oversight can result in unbearable consequences.
